When can I apply for a divorce?

In Australia, divorce is based on the irretrievable breakdown of the marriage.

Generally, you can apply for a divorce once you and your former spouse have been separated for at least 12 months and one day.

You can still be considered separated if you have continued living under the same roof, although additional information and evidence may be required as part of your application.

Do we need to agree to the divorce?

No. You do not need your former spouse's agreement to obtain a divorce.

A Divorce Application can be made either:

  • jointly, where both parties complete the application together; or

  • solely, where one spouse makes the application and the documents are then formally served on the other spouse.

If communication between you and your former spouse is amicable, a joint application can often provide a straightforward way to complete the process.
